Wavqu Terms of Service

Last updated: 25 October 2026
Version: 1.0

These terms are a contract between you and us. Please read them before you subscribe. They are written in plain English. If anything is unclear, contact us before you pay.

Please also read our Risk Disclosure, Subscription and Refund Policy and Privacy Policy. They form part of these terms.

1. Who we are

Wavqu provides the service described in these terms.

In these terms, "Wavqu", "we", "us" and "our" mean Wavqu. "You" and "your" mean the person who creates a Wavqu account.

You can contact us at support@wavqu.com. Section 23 has our contact details.

2. Key points in short

This summary does not replace the full terms below.

  • Wavqu is software. It is not investment advice and it is not a managed account.
  • Your money stays with your broker. We never hold, receive or move your trading funds.
  • The strategy is a grid (averaging) system. It does not use a stop loss on each trade. It can have large losses.
  • We do not promise any profit or any level of performance.
  • One subscription covers one MetaTrader 4 (MT4) account. You can change that account once every 30 days.
  • Card subscriptions renew automatically until you cancel. Each renewal is charged 7 days before your current access ends and buys the next period. Crypto payments buy a fixed period and do not renew.
  • All subscription purchases are final. We do not offer voluntary refunds. Your legal rights are not affected.
  • Starter, Standard and Pro each have a deposit limit on your own money in the account. Profit can take your balance above it.
  • Ultimate has no deposit limit. It uses the same strategy and risk controls as every other plan.
  • Assisted setup is an optional, one-time paid service. It is setup help only, not investment advice.
  • If our server is offline, Wavqu cannot open new trades for you.

3. Who can use Wavqu

To use Wavqu you must:

  1. be at least 18 years old;
  2. be legally able to enter into a contract;
  3. not live in, or use Wavqu from, a country where using it, or trading the products it trades, is against the law; and
  4. not be a person we are prohibited from dealing with under sanctions law.

We do not exclude any particular country. We do not offer Wavqu where the law prohibits it or where sanctions prevent us from dealing with you.

It is your job to check that you are allowed to use Wavqu, and to trade bitcoin with your broker, where you live. If you are not sure, do not subscribe.

4. What Wavqu is

4.1 The service

Wavqu has three parts:

  1. The website. You create an account, choose a plan, pay, and see your dashboard.
  2. The Wavqu Expert Advisor (EA). This is a small program you install in MetaTrader 4 on your own computer or on a virtual private server (VPS).
  3. The Wavqu server. We run the trading strategy on our server.

The EA sends information from your MT4 account to our server. This includes your balance, equity, prices, and the trades Wavqu has open. Our server works out what the strategy should do. It sends back trading instructions, such as "open a buy", "change a take-profit" or "close a trade". The EA checks the instructions are genuine and then places them on your broker account.

The strategy trades BTCUSD (bitcoin against the US dollar) only. It is a grid and averaging strategy. The Risk Disclosure explains how it works and what can go wrong.

4.2 What Wavqu is not

  • Not investment advice. We do not look at your personal situation. We do not tell you whether trading is right for you. Nothing on our website, dashboard, emails or support messages is a personal recommendation.
  • Not a managed account. We do not have access to your broker account login. We do not hold your money. The trades happen on your account, through your MT4, under your control. You can stop Wavqu at any time by removing the EA from your chart. Optional assisted setup (section 4.4) does not change this.
  • Not a broker. We do not execute trades on any market ourselves. Your broker does.
  • Not a guarantee. See section 5.

4.3 What you need

To use Wavqu you need all of the following. You are responsible for getting and paying for them.

  • A broker account that offers BTCUSD on MetaTrader 4.
  • A broker account that allows hedging. The strategy sometimes holds a buy and a sell at the same time. "Netting" accounts, where opposite trades cancel each other out, will not work.
  • MetaTrader 4 for Windows, running all the time. In practice this usually means a Windows VPS. A home PC that sleeps, restarts or goes offline will stop the EA working during that time.
  • Our server address added to MT4's list of allowed web addresses ("Allow WebRequest for listed URL"). The setup page shows the exact address.
  • MT4's Account History tab set to "All History". We need the full deposit, withdrawal and closed-trade history to check your deposit limit (section 7.2). On Starter, Standard and Pro, new baskets pause while the EA cannot report this history. It also gives complete figures on your dashboard.
  • A reliable internet connection.

4.4 Assisted setup (optional)

Assisted setup is an optional paid service. It costs $50, one time. A member of our support team connects to your computer or VPS through TeamViewer and helps you install and configure Wavqu in MT4.

  • It is optional. It is shown pre-selected at checkout and can be unticked before you pay.
  • You need a paid Wavqu subscription before we deliver the session.
  • You book it through the support email, support@wavqu.com.
  • The fee is separate from your subscription charges and renewals. It is not part of your subscription price and is not charged again at renewal.
  • It is installation and configuration support only. It is not investment advice. It does not guarantee any trading result.
  • You start each session and stay present throughout. We connect only with your explicit consent. We never use unattended access.
  • You type your broker passwords and security codes yourself. We never ask for seed phrases, private keys or control over withdrawals. We never store TeamViewer passwords.
  • We end remote access when the session finishes.
  • You stay responsible for your MT4, your VPS and your broker account (section 6).
  • The fee follows the same refund rules as subscriptions (section 10.5). All purchases are final.

The Subscription and Refund Policy has the details.

5. No guarantee of results

We do not guarantee that Wavqu will make money. You may lose some or all of the money in your broker account.

  • Past results, backtests and dashboard figures do not tell you what will happen in future.
  • We do not publish projected returns.
  • Anyone who tells you Wavqu will earn a set return is not speaking for us.

You should only trade with money you can afford to lose.

6. Your responsibilities

6.1 Your broker, your money, your choices

You choose your broker. You choose how much money to put in the account. You choose the leverage on the account. Wavqu does not control any of these.

You are responsible for:

  • your relationship with your broker, including its fees, spreads, commissions, overnight charges (swap), margin rules and stop-out level;
  • checking your broker is suitable and trustworthy;
  • checking your broker allows automated trading and hedging;
  • making sure your account has enough margin for the strategy's trades;
  • any tax you owe on your trading results; and
  • deciding whether automated trading suits you.

6.2 Your MT4 and VPS

You are responsible for keeping MT4 running, connected and up to date, and for your VPS or computer. If MT4 is closed, or your VPS goes down, Wavqu cannot manage your trades. That includes the local safety net described in section 12.

6.3 Other trading on the same account

We recommend you use a separate broker account only for Wavqu. If you trade by hand, or run other EAs, on the same account:

  • those trades use margin that Wavqu's trades may need;
  • they change the balance and equity that the safety thresholds are measured against; and
  • results on your dashboard will only show Wavqu's trades.

Do not change or close Wavqu's trades by hand unless you mean to take over from the strategy. Doing so can change how the strategy behaves.

6.4 Your account and licence key

When you subscribe you get a licence key. Keep it private. Do not share it. You are responsible for anything done with your Wavqu login or licence key, unless it was our fault.

Tell us straight away at support@wavqu.com if you think someone else has your login or key.

6.5 Accurate information

You must give us accurate information, including your email address and your MT4 account number. Keep them up to date.

7. Plans and deposit limits

7.1 The plans

PlanMonthly price6-month price, paid upfrontAnnual price, paid upfrontDeposit limit
Starter$100$575$1,100$2,000
Standard$250$1,375$2,625$5,000
Pro$500$2,625$5,000$10,000
Ultimate$1,000$5,250$10,000Unlimited (section 7.7)

Prices are in US dollars. Six-month and annual access is charged upfront, in one payment. The website shows each six-month and annual discount as a percentage against the monthly price.

Introductory offer. The first month of Starter with monthly billing costs $50 instead of $100. From the second month, the normal monthly price of $100 applies. There is one introductory month per customer and per MT4 account. The offer is not available on six-month or annual billing, on a downgrade to Starter, or if you cancel and subscribe again. It does not apply to Ultimate. The Subscription and Refund Policy has the details.

7.2 What the deposit limit means

Starter, Standard and Pro each have a deposit limit. Ultimate does not (section 7.7). A deposit limit applies to your own money in the account, which we call your "capital at risk". It does not limit how large your balance can grow.

  • Capital at risk = external deposits, minus external withdrawals, minus the account's net realised trading loss. The realised part counts only while the account's closed trades add up to a net loss. A net realised profit counts as zero.
  • Available deposit allowance = deposit limit minus capital at risk.

This means:

  • deposits use up your allowance;
  • withdrawals and realised trading losses restore it;
  • realised profit never counts against it, so profit can take your balance above the deposit limit without restricting trading;
  • if a realised loss is later won back by trading, the allowance it freed is used up again;
  • only closed trades count. Floating losses on open trades do not;
  • an available deposit allowance of zero is allowed.

The deposit limit applies in your MT4 account's deposit currency. There is no exchange-rate conversion. For example, the Starter deposit limit is $2,000, or 2,000 in GBP or EUR. These are account eligibility limits, not recommended investment amounts.

We work out your capital at risk from the deposit, withdrawal and closed-trade history that your MT4 terminal reports. The EA sends it when it checks in.

Deposit reporting. On Starter, Standard and Pro, new baskets need reliable deposit reporting. If the Wavqu EA cannot report your funding, your eligibility is "unverified" and Wavqu pauses new baskets. This happens if:

  • your EA is out of date and does not report deposits. You need to update the Wavqu EA;
  • your history has not been reported yet. You need to wait for reporting to finish;
  • your history is incomplete or does not reconcile with your balance. You need to set MT4's Account History tab to "All History". This can happen, for example, if you funded the account before installing the Wavqu EA.

Your dashboard tells you which applies. While new baskets are paused, existing baskets continue normal management, including grid additions, hedges, take-profits and the local safety net (section 12). New baskets can start again once reporting is reliable and your capital at risk is within your deposit limit. If the problem does not clear, contact us at support@wavqu.com.

Dashboard statistics may take up to 24 hours to appear. This delay is separate from the reporting needed for eligibility.

At launch, Wavqu supports accounts in GBP, USD and EUR only. If your account uses another currency, contact us at support@wavqu.com before you subscribe. We need to review it first.

7.3 If a deposit goes over your allowance

Wavqu cannot stop you depositing at your broker. On Starter, Standard or Pro, if you deposit more than your available deposit allowance, so that your capital at risk is above your deposit limit:

  • Wavqu pauses new baskets;
  • existing baskets continue normal management, including grid additions and hedges. They are not closed because of the deposit limit. They keep their take-profit levels and stay under the EA's local safety net (section 12).

New baskets can start again automatically once your capital at risk is back at or below the deposit limit, for example after a withdrawal. Realised trading losses also count. New baskets can also start again if you upgrade to a plan whose deposit limit covers your capital at risk, or to Ultimate. The strategy decides when the next basket starts.

7.4 One account per subscription

Each subscription covers one MT4 account number. Our server only accepts check-ins from that account. If you want Wavqu on two accounts, you need two subscriptions.

7.5 Changing your MT4 account

You can change the MT4 account number linked to your subscription once every 30 days, on your dashboard. When you do:

  • your licence key stays the same and moves to the new account number;
  • the old account number stops being accepted straight away, so Wavqu stops sending it instructions;
  • any trades still open on the old account keep their take-profits and the local safety net, for as long as the EA stays attached there;
  • dashboard figures start again for the new account.

The dashboard shows the date of your next allowed change.

7.6 How the strategy is set

We set the strategy's settings, including the strategy's risk settings, on our server. You cannot change the strategy itself. We may change it under section 16. Ultimate uses the same strategy as every other plan (section 7.7).

Every plan can use every trading profile (Low, Medium, High and Very High) and any lot-protection setting. You choose them on your dashboard. We may in future charge an additional fee for some trading profiles. If we do, we will give you at least the notice in section 16.2 before any additional fee applies to you, and you will be able to keep using the profiles included in your plan at no extra cost or cancel under section 10.

7.7 Ultimate

Ultimate has an unlimited deposit allowance.

  • "Unlimited" refers only to the deposit allowance. It does not mean unlimited trading exposure. It does not remove any risk control.
  • Ultimate uses the same trading strategy as every other plan. Position sizing, the grid, hedges, entries, exits and protective controls, including the local safety net (section 12), are unchanged.
  • Ultimate never pauses new baskets because of your starting balance, additional deposits, or deposit history that cannot be verified.
  • All other checks still apply, including the licence, payment, account currency and linked account checks.
  • The EA still reports your funding history, and we keep it.
  • Ultimate applies only after your payment is verified as successful.
  • It covers one MT4 account (section 7.4).
  • It is available as a card subscription or as Bitcoin prepaid access. The introductory offer does not apply.

Upgrading to Ultimate. The upgrade takes effect after your payment is verified as successful (sections 8.2 and 9). Any pause caused by your deposits or by deposit reporting then ends. The strategy decides when the next basket starts.

Downgrading from Ultimate. The downgrade takes effect at the end of your current paid period (sections 8.3 and 9). We then check your new plan's deposit limit against your account's preserved funding history. If your capital at risk is over that limit, new baskets pause and existing baskets continue normal management, as in section 7.3. The deposit reporting rules in section 7.2 then apply.

8. Paying by card (automatic renewal)

Card payments are handled by Stripe. We never see or store your full card number.

8.1 Renewal

A card subscription renews automatically until you cancel. This is how the timing works:

  • When you subscribe, you pay the full price of your first period (one month, six months or one year) and get access for that whole period.
  • Each renewal is charged 7 days before your current access ends, and buys the next period. Every payment buys one full period of access, so you never pay for the same days twice and no days are free.
  • For example: subscribe to a monthly plan on 1 October and your access runs to 1 November; the next payment is taken on 24 October, 7 days before, and buys the month from 1 November. The same rule applies to six-month and annual plans.
  • We email you 3 days before every renewal charge with the amount and the date. Your dashboard always shows your next charge date and the date your access runs to.

We will tell you by email before any price change (section 16.2).

8.2 Upgrades

The plans in order, lowest first, are Starter, Standard, Pro and Ultimate. An upgrade is a change where the plan stays the same or goes higher, and the billing period stays the same or gets longer. We charge you the difference for the rest of your current period, through Stripe ("proration"). The confirmation page shows the amount, and your new renewal date, before you agree. The upgrade starts straight away once that payment goes through, and the new deposit limit applies at once. Section 7.7 covers upgrades to Ultimate.

8.3 Downgrades

A downgrade is any change where the plan goes lower or the billing period gets shorter, even if the other part goes up. The whole change starts on your next charge date, 7 days before your current access ends, and that charge is at the new plan's price. You keep your current plan until then. No refund or credit is given for a downgrade. Section 7.7 covers downgrades from Ultimate.

8.4 Failed payments

If a renewal payment fails:

  • your subscription is marked "past due"; your dashboard shows how many days of access are left and an "Update card" button, and we email you the same day;
  • you keep access for the 7 days you have already paid for, while Stripe retries your card;
  • if a retry or your updated card goes through in that time, your access carries on without a break, as a normal renewal;
  • if the payment has still not gone through when your access ends, new trading instructions stop until you subscribe again. No extra days are given;
  • open trades keep their take-profits and the local safety net throughout.

When a payment goes through, the same licence key works again.

9. Paying with crypto (prepaid, no renewal)

You can also pay with Bitcoin. We take Bitcoin payments through BTCPay Server, payment software that we run on our own infrastructure. No outside payment company is involved.

  • We accept Bitcoin (BTC) sent on the Bitcoin network ("on-chain"). If we add Lightning payments later, we will update this section.
  • A crypto payment buys one month, six months or one year of access to one plan. You pay for the whole period upfront.
  • It does not renew. Access expires at the end of the period unless you pay again.
  • The amount you must send is set in the payment request (the "invoice") when you create it. Bitcoin prices move, so the invoice is only valid for a limited time: 30 minutes from when it is created. After that it expires and you need to create a new one.
  • You must pay any network (blockchain) fees.
  • Access starts when the payment is confirmed on the Bitcoin network and by our BTCPay Server, not when you send it.

Underpayments, overpayments, duplicate payments, late payments and payments sent on the wrong network are "payment exceptions". We record them for manual review. We do not refund them automatically, and we do not turn extra funds into extra access. To resolve one, contact us at support@wavqu.com. The Subscription and Refund Policy explains what happens.

Upgrades and downgrades mean the same as in sections 8.2 and 8.3, including changes that combine a plan and a billing period.

Upgrades. To upgrade, you pay a separate invoice for the difference for the rest of your current period (the prorated difference). The upgrade starts when that invoice is paid and settled. If the billing period stays the same, your period end date does not change. If the billing period gets longer, your new end date is measured from the start of your current period. The invoice shows your new end date.

Downgrades. A downgrade starts at the end of your current paid period. You choose the lower plan or shorter interval when you buy your next period. No refund or credit is given for a downgrade.

Switching to card billing. You can switch from crypto to a card subscription. The card subscription starts at the end of your current prepaid period. Prepaid crypto time is not carried over or refunded.

10. Cancelling

10.1 Cancelling a card subscription

You can cancel at any time from your dashboard. When you cancel:

  • future charges stop; the renewal that would have been taken 7 days before your access ends is not taken;
  • you keep access until the date you have paid to, which your dashboard shows;
  • you can undo the cancellation ("Resume") until your last charge date; after that, subscribe again from the dashboard;
  • no refund is given for the rest of the period (see section 10.5).

10.2 Crypto access

Crypto access does not renew, so there is nothing to cancel. It expires at the end of the paid period unless you buy another period.

10.3 Cancelling does not close your trades

When your access ends, new instructions stop. Trades that are open at that time stay open. They keep their take-profits and stay under the local safety net while the EA is attached and MT4 is running. If you remove the EA, the safety net stops too. If you want the trades closed, close them in MT4 yourself.

10.4 Your statutory rights

If you are a consumer, the law of the country where you live may give you rights to cancel or to a refund. Nothing in these terms affects your statutory consumer rights. The Subscription and Refund Policy explains how to use them.

10.5 Refunds

  • All subscription purchases are final. This applies to card and crypto payments.
  • We do not offer voluntary refunds, a money-back guarantee or refunds for unused access.
  • Trading losses do not entitle you to a refund of your subscription.
  • The optional assisted setup fee (section 4.4) follows these same rules.
  • We explain this before you pay.
  • The Subscription and Refund Policy lists the refunds we owe you, for example if we stop offering Wavqu (section 16.4) or end your access without good reason (section 17).
  • This does not affect your statutory consumer rights (section 10.4).

11. Your licence to use Wavqu

11.1 What we allow

While your subscription is active and you follow these terms, we give you a personal licence to:

  • download and install the Wavqu EA;
  • run it on one MT4 account, the one linked to your subscription; and
  • use the website and dashboard.

The licence is non-exclusive. It ends when your subscription ends. You may keep the EA installed after that so that the local safety net can manage open trades, but it will not receive new instructions.

11.2 What you must not do

You must not:

  • share, sell, rent, lend or transfer your licence key, the EA or your account to anyone else;
  • use one subscription on more than one MT4 account at a time;
  • copy, change, or create other software from the EA, except as the law allows;
  • reverse engineer, decompile or disassemble the EA, or try to find out how the server or strategy works, except where the law says you may do so and you cannot contract out of that right;
  • try to get around the deposit limit, the deposit reporting, the account check, the licence check or the signature check;
  • send false data to our server, or build your own program to talk to our server;
  • remove or hide any copyright or other notice in the EA or website.

11.3 Who owns what

We, or our licensors, own all rights in Wavqu, including the EA, the server software, the strategy, the website and the Wavqu name. You get only the rights set out in section 11.1.

12. The local safety net

The EA has a built-in safety net. It runs on your computer or VPS, whether or not our server is reachable. It closes all trades that Wavqu opened on BTCUSD on your account if either:

  • the floating loss on those trades reaches 32% of your account balance; or
  • your account equity falls 45% below the highest equity the EA has recorded.

The safety net only works while MT4 is running and the EA is attached. It does not close trades you opened yourself or trades opened by other EAs. It does not stop losses. It takes a loss to stop it growing further. Losses can go beyond these levels, for example if the price gaps or your broker fills orders at a worse price. See the Risk Disclosure.

13. Acceptable use

You must not use Wavqu:

  • in any way that breaks the law or your broker's terms;
  • to attack, overload, scan or probe our server or website;
  • to send automated requests to our website, other than the EA's normal check-ins;
  • to collect other customers' data;
  • to upload or send viruses or harmful code;
  • to market or sell Wavqu, or claim to represent us, without our written permission;
  • to make claims to others about Wavqu's returns that are not true or not fair.

14. Availability and what happens during downtime

14.1 Wavqu depends on our server

The strategy runs on our server, not in the EA. If our server is offline, slow, or cannot be reached from your MT4, Wavqu cannot open new trades for you.

We aim to keep the server running at all times. But we do not promise it will always be available, error-free or fast. It may be unavailable because of maintenance, faults, attacks, or problems with our hosting provider or the internet. Where we can, we will give notice of planned maintenance by email to the address on your account.

14.2 What the EA does when it cannot reach our server

If the EA cannot reach our server, or gets a reply it cannot verify, it:

  1. leaves all take-profit levels exactly as they were last set, so open trades can still close at their target;
  2. opens nothing new and changes nothing;
  3. shows a message on the chart and keeps trying again every few seconds;
  4. keeps running the local safety net (section 12).

14.3 What is not protected during downtime

While our server is unreachable:

  • no new trades are opened, including new grid trades;
  • no hedge trades are opened;
  • take-profit levels are not recalculated;
  • the server's own risk rules do not run. Only the local safety net does.

This means a losing group of trades may stay open longer than it would otherwise. It may also close at a different result than if the server had been online.

We do not give credits or refunds for server outages, however long they last. The final-sale policy in section 10.5 applies. We aim to keep the server available at all times and we tell you about planned maintenance by email, but availability is not guaranteed.

15. Dashboard figures

The dashboard shows figures such as profit or loss and trade lists. They are for your information only.

  • They only include trades placed by Wavqu, from the date tracking started.
  • They may be incomplete, for example if MT4's Account History tab is not set to "All History", or if MT4 has not checked in.
  • They may take up to 24 hours to appear. This delay is separate from the deposit reporting needed for eligibility (section 7.2).
  • They do not include your subscription fees.
  • Your broker's records are the official record of your account.

16. Changes

16.1 Changes to the service

We may change Wavqu. This includes the strategy, its settings, the EA, and the website. We may do this to improve the service, fix problems, manage risk, or follow the law.

If a change will significantly affect how Wavqu trades on your account, we will tell you by email at least 14 days before it applies, unless we need to act faster to protect customers, for security, or for legal reasons. If you do not accept the change, you can cancel. If the change is to your disadvantage and you cancel because of it, we will refund any payment for time after the change takes effect.

You may need to install a new version of the EA from time to time. Older versions may stop working.

16.2 Changes to prices

We may change our prices. For card subscriptions, we will email you at least 30 days before a new price applies at your next renewal. If you do not want to pay the new price, cancel before the renewal date. Crypto periods you have already paid for are not affected.

16.3 Changes to these terms

We may update these terms. We will email you about important changes at least 30 days before they apply. The date at the top shows when they last changed. If you do not accept the new terms, you can cancel.

16.4 If we stop offering Wavqu

If we decide to stop offering Wavqu altogether, we will give you at least 30 days' notice and refund any amount you have paid for time after the service ends.

17. Suspending or ending your account

We may suspend or end your access straight away if:

  • you seriously or repeatedly break these terms;
  • you share your licence key or try to get around the licence checks;
  • we reasonably suspect fraud or misuse;
  • a payment is reversed (for example a chargeback) without good reason; or
  • we must do so by law.

If we end your access for one of these reasons, we do not have to give a refund, unless the law says otherwise.

If we end your access for any other reason, we will give you reasonable notice and refund any amount you have paid for time after your access ends.

When your access ends, new instructions stop. Your open trades are treated as in section 10.3.

18. Our responsibility to you

18.1 If you are a consumer

If you are a consumer, the law of the country where you live may give you rights that cannot be excluded. For example, digital content may have to be as described and fit for purpose, and services may have to be provided with reasonable care and skill. Nothing in these terms affects those rights.

We are responsible for loss or damage you suffer that is a foreseeable result of us breaking this contract or failing to use reasonable care and skill. Loss is foreseeable if it is obvious it will happen, or if both of us knew it might happen when you subscribed.

We are not responsible for:

  • losses caused by market movements, or by the strategy working as described in these terms and the Risk Disclosure. Trading losses of this kind are a risk you accept when you use Wavqu;
  • losses caused by your broker, including its prices, fills, spreads, swaps, margin calls, stop-outs, outages or insolvency;
  • losses caused by your computer, VPS, internet connection or MT4 not running or not working;
  • losses caused by you, for example sharing your licence key, changing Wavqu's trades by hand, or not following the setup instructions;
  • losses caused by events outside our reasonable control (section 18.4);
  • losses that were not foreseeable.

Subject to section 18.3, if we are responsible for a loss, our total liability to you for all claims in any 12-month period is limited to the total fees you paid to Wavqu in the 12 months before the event giving rise to the claim.

18.2 If you are a business

If you use Wavqu for your business, the following also applies. We are not liable for loss of profit, loss of revenue, loss of business, loss of data, trading losses, or any indirect or consequential loss. Our total liability is limited to the fees you paid us in the 12 months before the claim. Implied terms are excluded as far as the law allows.

18.3 What we never limit

Nothing in these terms limits or excludes our liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • anything else that cannot be limited or excluded by law, including your rights as a consumer that cannot be taken away.

18.4 Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control. Examples include failures of hosting providers, internet outages, cyber attacks, power cuts, broker or exchange outages, changes in law, and natural disasters. If this happens, we will tell you as soon as we can and do what we reasonably can to limit the effect.

19. Your responsibility to us

If you are a consumer, you are responsible for losses you cause us by breaking these terms, where those losses were foreseeable.

If you use Wavqu for your business, you agree to cover our reasonable losses, costs and legal fees caused by a claim from someone else that arises from your breach of these terms or your misuse of Wavqu.

20. Complaints

If you have a complaint, email support@wavqu.com. We aim to reply within 5 working days. If we cannot fix it, we will explain why.

Complaints about your broker, your trades' execution, or your broker account must go to your broker.

21. Law and courts

These terms are governed by the law of Ireland. Any dispute about them, or about Wavqu, is decided by the courts of Ireland.

If you are a consumer, you keep any protection given to you by the mandatory consumer law of the country where you live, and you may be able to bring a claim in the courts of that country.

22. Other legal terms

  • Whole agreement. These terms, and the policies linked from them, are the whole agreement between us about Wavqu.
  • Transfer. We may transfer our rights and duties under these terms to another organisation. We will tell you if we do, and this will not reduce your rights. You may not transfer your rights or duties to anyone else.
  • Third parties. No one other than you and us has any right to enforce these terms.
  • If part of these terms is invalid. The rest still applies.
  • Delay. If we do not enforce our rights straight away, we can still enforce them later.
  • Emails. We will contact you by email at the address on your account. Please keep it up to date and check it regularly. Some emails, such as payment and security notices, are part of the service and cannot be turned off.
